Someone should look into the SC Freedom of Information Act implications of SG going into executive session. S.C. Code Ann. 30-4-10 et seq. Seems like SG qualifies as a public body to me. Hope they were looking into a pesonnel matter rather than just bitching about the video in secret.

I actually challenged an SG Senator about the legality of the Senate going into executive session. They are a public body, because they distribute student funds (or maybe that's just the finance committee), but anyway, I told him that they had no legitimate reason for going into exec session. He said "but it was a personnel issue." I countered with "no it wasn't, since Tommy Preston specifically said it wasn't about one person." The Senator had no reply except surprise that I knew the details of the session.
The Senate also went into executive session near the end of the 97th Senate session. Its purpose? To read a poem that made fun of the Senators. (It got a brief mention here: http://www.dailygamecock.com/med...414-

Originally, as in years past, the poem would have been read in open session, on film. But as the camera ran out of tape and had to be changed, Holt and Stoudenmire decided it would be a good idea to read the poem in executive session. Non-members were not shoed out of the room as they were during Wednesday's exec session, but obviously could not disclose the contents of the poem, which was stupid.
I'm inclined to say that the Senate should just send out these stupid poems and chastisements about Senatorial behavior via e-mail or some other way, but then we wouldn't get to know about it. So exec session all you like, kids, because it won't stay executive if its for no reason!

That's fascinating, j. I wonder what other abuses of the rules Student Government has conducted in recent months? Do the rules delineate any sanctions/remedies for rule violations?

Actually, under the Freedom of Information Act, the Student Senate is allowed to go into Executive Session under Section 30-4-40, in this case, specifically subsection a-2, which allows information of a personal nature to be excluded.

I know this is days late, but I had to respond to Anonymous (cough cough Tommy or Ryan cough)
Subsection a-2 says: "Information of a personal nature where the public disclosure thereof would constitute unreasonable invasion of personal privacy. Information of a personal nature shall include, but not be limited to, information as to gross receipts contained in applications for business licenses and information relating to public records which include the name, address, and telephone number or other such information of an individual or individuals who are handicapped or disabled when the information is requested for person to person commercial solicitation of handicapped persons solely by virtue of their handicap. This provision must not be interpreted to restrict access by the public and press to information contained in public records."
I know it says "but not limited to," but how in your mind do you stretch not disclosing home telephone and address to not disclosing that people are calling Student Government silly and unprofessional? In my mind, a professional student government might have been open with the public and said "you know what, this video has become an Internet phenomenon but it was a one-time thing and it doesn't represent SG as a whole." Instead you go behind closed doors and force everyone to keep their mouths shut, or be impeached. That's silly and unprofessional, guys.
