Yeah, but getting a warrant would not be that hard. This just feeds into the idea that the Bush Admin thinks itself as "above the law" (but what presidency doesn't?).
I'm a democrat, but am very uncomfortable about this "opportunity" for us. We don't have out sh!t together and pray for moments like this. Look at who we have for DNC head!!! Vermont Separtist Dean??? Whatever happened to go old moderation?
If the Admin violated the Fourth Amendment, he should be punished. Impeachment if need be. But let it be the right thing, not the politically expedient thing. Unfortunately, I see the latter.

Wouldn’t you like to know the names of congressional leaders receiving the briefing and who leaked this information to the NYT? Perhaps the Whitehouse can be persuaded to provide a list.

One of the possibilities is that the Intel committee chairs and minority leaders were in on the briefings - or the subcommittees in charge of FISA oversight.
And there's another aspect of the Times story - they sat on it for more than a year, and yet they deem this a civil liberties issue? To be announced on the day after elections in Iraq? That's curious timing to say the least.

Glenn Greenwald has another take to the FISA story: Purposely misquoting FISA to defend the Bush Administration. I'm not lawyer enough to evaluate the arguments myself...
