Let's be clear, though: the Court has 'banned' nothing. It has done its Constitutional duty in deciding if a law duly passed by a Congress composed of elected representatives of the People was constitutional.

Sorry. I know you say 'upheld' in several places (hell, even at the beginning of the quoted phrase) but I'm just overly twitchy by all the screaming about the SCOTUS.

You're right about the specifics of the words. The Court upheld the federal law, enacted by Congress and signed by the President, which bans the procedure.
