Bummer Betsy. Did you get a police report on it? They are the one's with the final say on who's fault it was.
I didn't get a police report once and that was a really bad deal.

Yeah, David, I called the police, but was told because it happened on private property (the Albertson's parking lot), they didn't get involved. She said that the insurance companies will investigate and declare fault. My insurance agent said that the law is that since I was moving in the parking lot "lane" and he was backing out of a space, I had right of way and therefore he is at fault. She also said that sometimes insurance companies will assign a percentage of fault to the other driver, so we'll have to see.
@metromom - thanks. I don't feel any worse this morning than I have the past 5... I've been having all sorts of neck issues lately, but they're definitely not worse because of the accident!
Oh Betsy- I'm so sorry. That totally sucks!!! I've been there and so has metromom, so we know how you feel.
Please tell me you didn't spill your Starbucks though- because that would take the cake!

The same thing happened to me once..not being my fault, etc..and I got a nice sized check for my little car that probably wasn't even worth what they gave me..! I agree with Terri....hope you didn't spill the Starbucks! Have a great weekend girl!
