Gravatar I am now convinced you just don't believe in up holding the law. How many times have we heard we don't need more laws, we need to just enforce the laws on the books. There is a law that states you can not sell booze to an intoxicated person. Are you saying we should strike down the law? When someone agrees to a liqour liscense, they agree to abide by the law.
We hope when sentencing people that they will rehabilitate. It appearred this guy had done so, since you bring a 15 year old criminal record. Maybe you think we should just lock up people for life.
I agree with you that Pabst is main person at fault, but this guy wasn't brewing his own beer. Someone had to have helped him a long the way.

Gravatar Lets bring this to reality people, if this clerk sold papst acohol do you really think given the short amount of contact she would have had with him she wouldve been able to tell he was intoxicated unless it was completely obvious? The only person to be blamed here is papst himself, he is the only one who couldve prevented this from happening. He probably was intoxicated when he bought the beer so without the beer he probably still wouldve committed the tragedy he did.
You know and the fact that the airline he was on can no longer sell alcohol in NM doesnt stop anything either. Someone can get drunk at the airport before their flight, get off a plane drink some more and then drive. The only way drunk driving is going to stop is when these people are prosecuted and punished to the fullest extent the first time not the 12th or 13th time.

JB and Fred, my blog posts are made up of my opinions and my opinions alone. I am not part of Torraco's campaign. If I was, I would have added her name to the disclosures listed in my bio.

I don't poll before putting my opinions out there. What you see is what you get with me. I'm an active and supportive member of the Republican Party. I've never tried to hide that. However, I also STRONGLY value open dialogue and frank discussion from those with opinions different than my own. That's why I've always enabled public comments.

I've put up over 800 posts in the last three years and have been humbled, not only by the number of readers, but by the thousands of comments that have been left. I value all of them, even though I may disagree. The only time I have censored comments is when folks have impersonated other people, or have been offensive in their language.

I do believe in upholding the law, and I think this case is a perfect example of the fact that we have too many ridiculous laws on the books. I also believe that enforcement of our legal system should be based on what is just.

Somethings are black and white. Asking someone to determine whether or not someone else is intoxicated is not one of those things. It is completely subjective. There is a reason that breathalyzers and blood tests are used by law enforcement to prove someone's level of intoxication.

So, prosecuting someone for selling alcohol to an alcoholic who may or may not have outward signs of intoxication, is ridiculous. Yes, I believe the law should be stricken and MUCH harsher penalties for repeat offenders should be enforced.


Gravatar Mario, this problem can not be solved with only a couple of weapons. I worked in liqour industry for ten years, I have seen people served beyond their limit. Once someone has become intoxicated they lose reason. That is why it is important that server is properly trained to recognize drunk people.
Let me ask you this Mario. If a bartender, at a roadside bar serves a person ten shots in an hour and lets the guy walk out, he/she has no responsibility?
