I find this decision interesting considering the fact that there were no public schools when the Constitution was writen. As for the judge who cited the 1961 decision, "A primary purpose of the educational system is to train school children in good citizenship, patriotism and loyalty to the state and the nation as a means of protecting the public welfare." I don't believe the schools are doing a very good job of this either - Berkley for example.
