Gravatar First: Roberts and Scalia agreed wth the judgment of the court. Anyone remember who appointed those two?

Second: The law clealy says that one who commits three "violent felonies" should be sentenced to the 15 year mandatory minimum.

Burgos says that this guy was "...a violent crime waiting to happen.. ... it was only by a sheer stroke of luck that Larry Begay did not commit a violent crime."

Um, the usual principal is that unless one actually commits the crime, actually violates the statute, one shouldn't face the punishment. Close enough doesn't count. If one avoids the crime, even by luck, one shouldn't face the sentence.
