They will take anything down if it's not supposed to be there if challenged(compliance after the fact, it's a great strategy). they rely on some self-policing (liek craiglist) but they aren't making enough money yet to have full time staff checking all content (myspace has a team of about 5 who do nothing but search out bad pics and posts). I think they'll be fine or they'll take this run a long way. Their CEO is smart and lots of good people advising him. And lots of lawyers on the high end who'd take his case probably free or cheap to get the cache.
