My first thought was - here is another great artist who doesn't look beyond his walls.

My next observation was: the flowers on your picture appear as a more natural segment. The other picture has a mechanical kind of a beast: when have you last time seen a grey vase?

I have been blatantly copied since third grade. I think I've learnt something since then - I think one should be generous and take this kind of things as a flattery... not ALWAYS, but certainly OFTEN.

Gravatar I think you'll never know. Artists often come up with the same quirky ideas completely independently (you only have to look at the Illustration Friday entries to see that week in week out), so if you really think there's an issue it's courteous to speak to the artist privately to at least give them an opportunity to defend themselves. Legally you wouldn't get anywhere with claims of plagiarism on this one.

Yours is lovely and so is the other one.

Gravatar Since there seems to be a vote, emerging... I vote on the side of "not" plagiarism but definitely theme and variation. Once the multi-tentacled creature was upended, what else would you put on the ends of those stems but flowers?
With the web-searching text checkers, some instructors are calling it plagiarism if one author and another use the same THREE words consecutively. In a world of reductionist vocabularies, herd instincts and quick fixes, is it any wonder plagiarism seems to lurk everywhere? I worry more about the sly folks who plagiarize but then spend their efforts disguising it.

BTW... the trunk wrestling was terrific.

Gravatar tssk.. cant you sue them or something?? your work is way better than theirs! hmp..

Gravatar Over the past two months i have consistently been researching artists for a work project and have noticed that there are a lot of similarities in style, concept, ect between a wide variety of artists.
I personally don't think the Flood The Gutters concept was a bite, as i have seen quite a few similar concepts of squid/octopus with floral/fauna extensions that predate your piece and i really doubt that you plagirized their concepts.
Maybe great minds tend to think alike?

Gravatar Both are good pieces, but there are subtle differences between the two (one is a squid, the other an octopus - get it!). If you wanna take it up with the artists (I think it was a collaborative piece) you can probably get a hold of them from here: http:// www.newimageartgallery.co...urrentshow.html

Over the years friends have pointed out several pieces illustrated by various popular artists that closely resemble drawings I've done in the past and had been on my site for awhile. I never personally confronted them on it, but when my pals did, the other artists would always get defensive and claim that it was I that was ripping them off and that they've never even HEARD of me (even though my drawings were done months, sometimes years earlier). I say, live and let live and console yourself with this age old adage:

There's nothing new around the sun
Everything you think of has been done;
All been done before your time;
Sometime or another
By someone and his brother

Gravatar Yeah, it's definitely a ripoff of your concept...no two people would come up with such similar off-the-wall concepts. But then, the question becomes, what are you going to do about it? I say, relax and bask in the glow of knowing that someone thought you had an idea so fabulous they had to use it, too. After all, if you take 'em to court, what would you get?... enough in damages to pay the lawyers and the court costs, maybe, but you'd probably end up in the red. It's too bad people have to steal other's ideas, but then again, there are only so many geniuses in the world, and the rest have to rely on them to supply the stuff worth stealing.

Gravatar well, I dunno... if you were Disney or DC Comics a team of lawyers would have curb-stomped the perp before the paint had dried on his pallete. Within the artistic community, however I always think its best to "have a little chat" when these things arise... some people just need a bit of educating. That's especially true of the file-sharing generation. And sometimes coincidence happens... look at my avatar - I didn't intend it to look like Hot Stuf from the old Harvey Comics, but I know it does.

Gravatar Brandon. Friend. Pal. Say the word and I'll get the boys together to go and have a "talk" with the artist of this piece.

Gravatar Rose said:

"Since the giant squid was found this summer, the idea is kind of in the air."

And I have to agree. I think the only thing that is making me go "Hmmmm" is the flower bouquet on top. It is a very unique feature of both illos.

Have you tried to contact this other artist to ask? Perhaps he/she created it awile back, and is just reusing it now on this flyer.

On a side note, how do you feel about it? If he/she was inspired by your piece and created this on purpose... would you consider it plagarism? Would you be flattered? A little of both? Just curious. I don't think I've ever been put in that situation, and I'm not sure how I'd respond.

Gravatar A coincidence is entirely possible. Just because you've created something extremely clever doesn't mean someone else hasn't done the same but the truth is no one really knows unless you ask the other artist. Put your egos down for a second ponder the possibitly of this happening.

If this other artist did plagirize then who's the better artist? I don't know and I don't care- I like both pices. :P

Gravatar Thanks for all of your input everyone.

Shawn- Thanks man! That really means a lot coming from one of the most talented dudes in school... I remember constantly being blown away by your work.

Gravatar Impressive work Brandon! I don't remember you being this good!!! Outstanding. Very inspiring!

Gravatar I agree with you Brandon. Looks like plagarism to me...or perhaps the phenomenon of monkey's eventually typing Hamlet.

Gravatar They are both good illustrations, but I certainly wouldn't call plagarism on either of them. Since the giant squid was found this summer, the idea is kind of in the air. Having a different take on idea is just that, look at illustration friday!

Gravatar Both are quite nice, but I still favor yours more.

Gravatar Excuse me... nothing similar?

This person took a clever idea and concept, and rehashed it again. The execution may be different, but the overall theme and concept is exact, how's that "not" plagiarism?

Good grief.

Gravatar I dont see anything particularly similar about them esthetically or in execution. The basic premise may be similar.

Gravatar As artist's, we're all inspired everyday by other's in our craft, whatever that may be, but to sit here and downplay that "Flood the Gutters" is not blatant plagiarism is idiotic.

Gravatar Could definitely have been inspired by you but it is a complete and different illustration by itself. No harm, no foul.

Gravatar I have previously commented on your octopus, but I dig squid as well. Looks like they can all party at the Cephalopod Club. Must be a case of great minds think alike re: the similarity of the two images.

Gravatar Both are beautiful!! Lovely!
