1. As best I can figure out Rhenquist's vote, it fits a general theory of "whatever the religious majority wants to impose or is willing to accept is OK."
2. Any idea how much of a contribution it would make to closing the federal deficit to fire Thomas and give Scalia 2 votes?
The savings could be significant. In addition to Thomas's salary and benifits, there are the costs associated with printing pointless eighth grade essays like his dissent in this case. Scalia apparently makes friends easily, so it's not like Thomas needs to be kept around for companionship.
Have you been paying attention to the Blackmun tapes? I hope there's a book on these. I'd wade through the whole thing.
there's no doubt the writers of the
Constitution were geniuses.
The quality of the Court survives even the Thomas's (and there have been other Thomas's, I'm sure). Quite a miracle.
