I even see the framing of the legal argument in context of any entity of the governmint requiring this to be spoken. Why would I say that? Because the wording is precise in that the Federal Government cannot prescribe any form of religion for the people.
It doesn't say there can't be God written on a wall or a plastic backlit manger scene or the Boy Scouts can't benefit from government controlled resources.
It does say you can't make someone say something they don't agree with. However this case is using a sledge hammer to kill a fly. The answer is NOT to CRUSH the pledge, but to make it voluntary-sticks to both the INTENT and the LETTER of the law.

I've always found it curious that a country that puports to have "freedom of religion" goes and puts "God" on everything.
It's like Major League Baseball, which doesn't really care what team you cheer for, putting the Milwaukee Brewers logo on everything. (Y'know, with Bud Selig and all.) Works if you're a fan of the Brew Crew; not so much if you're a fan of the Tigers.
