1) Rural carriers do not wear uniforms. 2) "Gambling during duty hours" would also presumably include office sports pools, in which case approximately 80 percent of my facility staff would be subject to termination, including all current supervisors and managers.


Why would he lie about it unless there is more to the story than what was in the newspaper article.


It seems that management was looking for one more thing to fire this person for. As ASTF616 states, there would be a lot of folks on the outside and looking in, if they fired everyone who "gambled" while on duty. Was he officially off the clock for lunch? Yes and no, since he is a Rural and takes lunch on the road. However, what will be next? Getting in a traffic accident while officially off the clock, going to and from Lunch?


I think the firing is bs.
If gambling is a legal operation, the guy was on his own time, he should not have been fired.
He is not paid for his lunch time.

If a supervisor walks or drives to a lunch spot and gets in an accident or is run over........will he/she collect compensation from the postal service?

Sad case; I don't think he should have been fired, as he used bad judgement. But...rules are rules, I guess. Maybe our great union might be able to do something for him.

I always thought lunch time was our own time, or at least that is what I was told when I ws hired 31 years ago. You aren't paid for the time, so maybe under this firing we can all go file greivances on Friday to get our past lunch breaks paid!!!!!!!!


Figureing and average salary of $15 an hour over my 31 years, that would mean the USPS owes me $60,450.00!!!!!!!!! Show me the money!!!


YOU HAVE GOT TO BE KIDDING!! In just the past week I have seen money pooled for lottery tickets which were purchased on the clock, bets between employees on upcoming NFL games, employees going to casinos after work still in uniform, carriers calling bookies during break on cell phones making bets, and much more. And we fire a guy for just trying to kill time during lunch and getting lucky. And Jaffer steals thousands and gets a fond farewell write up from Potter. Now I know why I can't wait to retire next year. USPS has become heartless, evil, corrupt, and inhumane. A letter of warning or small suspension would have corrected the behavior. I bet he will get his job back cause no arbitrator in their right mind would uphold a termination for this incident. Add dumb to what USPS has become because they will surely pay alot of backpay to this carrier for their harsh decision.


I like the reasoning. It is like saying that a person only killed once, let's forget about it. Once you slide and compromise your ideals and principles, it is only a hop, skip and jump to allowing everything. In all my 30 years, I have never been asked nor have I seen a betting situation on any sport in the facilities I worked in. Our district has not allowed it for anyone.


I sincerely feel the punishment was too harsh. Was the policy firmly stated that "you will be fired if...?"
How many postal or any workplace are perfect? For example, there is no sex jokes, selling for profit (not to include benefit events, sports pools,taking too many and too long breaks? The list can go on. Verbal or written admonishment would have been sufficient, if the employee was not warned previously. Let's get real!


These have been in the regulations for about 75 years -- no gambling of any kind while on duty. If some management looks the other way, shame on them. But every new employee should have been told this during orientation. Frankly, this regulation should be rescinded -- it's BS.


What's the problem here? I bet on football cards every week during football season when I wasn't out spending the Postal Service's money. Hey, I even tipped the guy who ran the pool 100% especially if I won big that week.


The Post Office has hundreds of rules. Most of them are deliberately vague so that local management can interpret them for what ever agenda they have at the time. In this case I wouldn't be surprised if there is a 204-B bucking for a promotion. Of course this will be reversed - eventually.


Rural carriers don’t have or wear a uniform, so that issue is moot. The purchase of a state-authorized lottery ticket is legal in that state. The only issue, therefore, is whether the rural carrier was on an authorized lunch period when he purchased a lottery ticket. If so, he did nothing wrong.

Under the Fair Labor Standards Act, meal periods are not compensated as work time if the employee is “completely relieved from duty.” In this case it appears the Postal Service is claiming that the employee was “on duty” when he purchased the lottery ticket.

In my office supervisors participate in the office pool. Gambling activity is confined to breaks and lunch. The main mistake this rural carrier made was telling his coworkers about his big win. Then the knives came out!


Steward, rurals do not get a lunch break. If they take a lunch they are to report it on their time sheet.


Apparently this rural may have done that, could be why he lied to his supervisor.

This is just crap! How did the PO find out about the good luck in the first place?
They had to have the info to ask him about it in the first place! Was he being followed, spyed on, or something to that effect?
This sounds like a set-up to me, so what if he actually bought a ticket, was his privacy infringed on? Hell, we've even had supervisors pitch in a buck for a lotto pool!


There has to be more to this story. The first clue is that the press even got wind of this. It is likely that the carrier himself solicited that kind of help. No one gets fired first time out for gambling especially a state run lottery. More likely that progressive corrective action and something in addition to this act led to his dismissal. The gambling charge is just an add on and is likely being used as evidence that independently verifies some other violation that sent him over the top discipline wise. Which would explain why he lied about having done it in the first place (which is another problem with this guy), because it put him someplace he was not supposed to be. Hope for his sake the lottery is it... then he wins. If not this article will surely be used against him to show his lack of integrity which is a steward's worst nightmare for the person which he/she is advocating.


Great post, actionjackson. I can't improve a bit on it.

However, I believe when I started as a PTF clerk/carrier, we had certain "rules to follow". One of them was that we couldn't gamble OR drink while on duty, OR whenever we were wearing our uniform.

Now, in the case of a rural carrier, he/she "could be considered wearing a uniform", ""IF"" (going WAY out on thin ice with this)the vehicle that the person is driving has the US MAIL placard on it. He/she "appears" to be on duty delivering mail, even going so far as the scanner being in one's shirt pocket.

Now, I sure as hell hope that the firing IS recinded, as I've personally seen MANY people on the clock, whether it be management OR craft, gambling/buying lottery tickets/consuming alcohol whilst on the clock.

Was the rural carrier on a lunch break when he purchased a lottery ticket? If so, he did nothing wrong. Here is the actual NRLCA-USPS contract language:

"ARTICLE 30 WORKING RULES FOR RURAL CARRIERS

Section 1.F: Lunch Break

1. Rural carrier craft employees may stop for not more than thirty (30) minutes for lunch. If carriers stop for lunch, the exact time used must be recorded.

2. Lunch may be taken in segments of less than thirty (30) minutes, at the carrier’s option, provided the time taken does not exceed thirty (30) minutes. Segments may be taken in the office or on the route, provided the normal schedule is maintained to the extent possible. The parties agree that the lunch time taken by the carrier is not compensable.

3. Rural carrier craft employees may be permitted to travel a reasonable distance off their prescribed line of travel to and from an authorized lunch stop."

If the rural carrier was not on an authorized lunch break, the issue becomes did the punishment fit the offense? Removal for buying a state lottery ticket seems rather extreme when purchasing a hot dog would have been okay!


Alot of "mays" in what you wrote steward. Rurals signed off on FLSA about 35 years ago. The rural most likely did not record a lunch break on his time sheet, most likely the reason for lying to his supervisor. Henceforth he was on the clock.

Most of the rurals I know NEVER remove their US MAIL signs from their personal vehichles. They are found in association with EVERY TYPE of situation: drunken bashes,drug parties,casinos,alcohol retail outlets,speeding-highway misconduct-roadrage,public misconduct, cursing,abusive language etc,etc,etc,... They don't remove thier signs and ARE NEVER ASKED TO.So ,why all of sudden when this guy does something perfectly LEGAL is ther the big posturing of it being an issue?

Gee, how many employee's bang in every day and are not sick? Soon as they fill out a 3971 they are subject to $10,000 fine and what? 2 years in prison. How many carriers and window clerks take tips over the limit and everybody knows about it. How about the carriers who deliver thank you cards for those tips without postage. Raise your hands how many of you have football pools in your office or chip in when the lottery is 50 million.

Leave the guy alone or go after everyone. Disparity of treatment is a no no, but this is the Postal Service so I guess it's alright. He will sue and get his job back with back pay.

Interesting, our District holds their end-of-year and other functions at a local casino. And they don't do any gambling while there??? Right!


I really hope that there is more to this story, if not I am ashamed that we would fire a carrier over something as stupid and ridiculous as this. This poor carrier was not in a back room somewhere playing poker, or blackjack or playing the roulette wheel. This is unbelievable. I hope he gets his job back with back pay and damages.

You don't have to be a bad employee to get targeted by management. All you have to do is win a grievance that EMBRRASSES the postmaster! Then watch out! They actually think they have the right to ruin your career!!!


According to labor records he was formerly a rural carrier who was fired in 05 and the union got him reinstated as a city carrier on the condition he would be an exemplory employee. The lottery win was the final straw. This according to the Iowa unemployment records. The union upheld this firing and he was denied unemployment comp.


Acourding to labour records, yeah right. Sense when are these kind of records available to the public, or online! I think you're a lier!!!

The post on Sat. 9/9/06 makes everything clear. First and formost, the carrier was city craft, not rural. This explains the violation of gambling while on duty and in uniform. As several previous posts pointed out, a rural carrier on lunch break is not on the clock and we do not have a uniform. As the the severity of the punishment, the carrier was on a last chance agreement. This makes it possible and even moral to discharge the employee for even the smallest infraction. As the song says, "A man should never gamble what he can't aford to loose."


I read that he was fired from the city craft in 2005. He then somehow became an RCA. Anybody else read that? BTW, they were obviously gunning for this guy. He should have kept his mouth shut about his little win. Part of his LCA stated that he must be an "exemplary" employee.


I gamble all the time here in NJ, Infact I'm taking home boxes for my move to vegas so I can play the slots at lunch and hit the bunny ranches too


what about management putting your name in the hat for a drawing on the work room floor. Is that not a gamble, a chance? A chance to win dinner certificates, movie tickets.


Sure as hell is, whether it be $1.00 or $1000.00. Gambling is gambling.


as usual, managers can do almost anything, from flashing kids, home business phone calls at work, falsifying forms, to sex on the job and not get fired. They may get transferred but not fired. But let some poor carrier do something and the boom comes down.
