Gravatar Um, I don't think the facts are in order here. The man in cuffs was trying to get free, could have hurt himself and others, and could possibly have died because of the drugs in his system anyway. His autopsy showed that he had in fact been tased only ONCE. So much for an "eye witness" who has to remain anonymous, is probably related or a friend of the perp, and was more than likely high at the time as well. Now, because of the rampant drug problem in Raton, and most of the country, three men and their families have been thrown into turmoil, unable to pursue the profession they want to. Their lives are in upheaval, and their reputations are ruined. One of those men, a very good cop, was not even on the scene when this all went down. He's being held responsible because the other two officers were under his command. I think the Saenz family needs to accept that Jesse was doing something illegal that compromised his heart, made him irrational and more at risk.

-"The state's autopsy determined Saenz died from "excited delirium," which the coroner's report defines as a form of cocaine intoxication. The medical examiner classified the death as homicide, meaning "another party either knowingly or unknowingly was a factor contributing to the death."

The autopsy report concluded that "although the cause of death was likely a result of cocaine intoxication," Saenz's "breathing abilities were also impaired when he was placed in a prone (face down) position while supporting another person's body weight on his lower back." The report says the "means of physical restraint significantly contributed" to Saenz's death as the restraint means would have "heightened the effects of the body's internal hormonal and chemical derangements" triggered by the cocaine.

Prior to placing Saenz in the police car, Dominguez and Baca shocked him with Tasers. The officers said the Tasers had been used when Saenz became combative. They also reported they believed the Tasers were malfunctioning when they were using them.

State police determined the officers pulled the triggers of their Tasers a combined total of 23 times while dealing with Saenz, but could not determine the actual number of shocks administered to Saenz. An autopsy found that the Tasers did not contribute to Saenz's death."-

Gravatar It is very sad that Jesse died. But, so many times people want to point fingers and blame others. Perhaps we should look into why the police were called to the scene in the first place. Jesse was under the influence of intoxicating substances and was destructing another persons property. Is he not to blame for his actions? Basically his family is saying that it is the fault of the police officers that he was intoxicated with cocaine and that they made him destroy another person's property. NO - its not that way. Jesse was a grown adult who made decisions in his life that were bad. Unfortunately he paid the ultimate price for those actions and now his friends and family have to suffer. But why do the police officers and their families have to suffer as well? I do know one thing for sure. Justice will prevail.


Gravatar The autopsy I read said Jessie had at least four diffent drugs in his system. That he was tasered numerous times because they had no effect on jessie either due to drugs or deffective tasers.
Regardless, Jesse made bad choices and was violating the law. If anyone should be additionaly punished, maybe it should be Jessie's family for denying that they did a poor job raising their children and for failing to take the proper blame for their and Jessie' actions. I am not a big fan of most law enforcement officers because they tend to have a bully attitude (I know, I was one) but it seems very clear to me where the blame lies.
Had Jessie not been on drugs, had jessie not been damaging others property, had Jessie not been resisting arrest, Had Jessie not been so out of control that an officer had to sit on him, Maybe Jessie would be alive today.
In my day, an out of control criminal was usually subdued by unconsciusness thru the use of fists, blackjacks and night sticks.
When a suspect is out of control, he has to be subdued, some how, some way.
Jessie paid the price, the blame is his. The New Mexico State Attorney needs a little common sense.
Leave the cops alone and let them do what they are paid to due. Subdue and arrest criminals.

I might add that the three officers families (children at school) have reported receiving threats from the Saenz family and friends. This is the mentality of thugs, criminals and the Saenz family
