I think that the lawyer bloggers should be questioning what kind of "standard of proof" the Panel used to weigh the evidence in reaching its conclusion. I can't imagine what it was. The Panel had a high-powered law firm as counsel. Wouldn't you think that such a concept as burden or standard of proof would have been considered?
Politics probably played as big a role as anything else. Politics and the desire to avoid stepping on too many toes played as big a role in the report as any legal standard. The law always takes a back seat when legal issues mix with political issues.
It starts with why was dick hired? He was hired becaus he has been fighting the Bushes since 1992. He tried very hard not to find any political motivation for the smear or its timing. Because he tried not to find any he found none. Dick earned the money Viacom paid him.
