Lemme steer through the sarcasm here ...
OK. Just because someone says they're religious, doesn't mean they're religious. Just because someone says they're Muslim, doesn't make them Muslim. (I recently decided to take a hard line here. I'll declare it myself if I have to, even though I'm an atheist humanist).
The Onion's headline after 9/11 said it all, really: "GOD CLARIFIES NO-KILLING RULE".
Anyone who somehow shoehorns killing into their religious compatibility, has automatically given up their right to be considered religious, I say.
And that goes for the death penalty, too.

One does not have a "right" to be called religious or not. They do however have the "right" to declare themselves what they want; not that those "rights" amount to anything anyway.
To determine whether they are religious or not entails looking at the religion they claim to espouse and whether their actions place them within its dictates.
Since rarely does a page of the Koran go by without an injunction to go forth and make life short and miserable for the infidel, I must sadly conclude that Islamic Jihadists are religious. Further, they are Muslims following a long tradition in Islam.
