It's simple.
What Teddy seems to have forgotten is that people died to end slavery. Their representatives, after the war, and the survivors amended the Constitution to ban it and mandate equal treatment for all people by law.
And then - then - THE SUPREME COURT handed down a decision saying that equal treatment under the law did not mean that the law had to treat people equally.
That's the reality. The Supreme Court does not produce these advances in freedom. The people do.
What can you say to such nonsense, but the truth? The truth is that if the Supreme Court of that time had been occupied by textualist judges like Roberts and Alito would not have made the mistake of Plessy.
So Teddy was sobbing while he should have been clapping, right?
