The town seems to be leaving itself open to a lawsuit. I am surprised the local citizens would tolerate this.

It was even worse in the past. One former police chief went to prison for planning a mob hit. Really.
I think you'll find that around 25% to 30% of town revenue comes from the police operations. People no doubt tolerate it because it a means of transfering wealth from out of towners to those who live in town -- via whatever "services" the city gives them at the expense of non-voters.
It is almost the perfect dream for a politician. Get elected by voters who are all recipients of your "generosity" while having it funded by individuals who have no vote.
