Here is a copy of an e-mail sent to from Ian Jarvis (BW) - Update on repairs to the weir:

I had hoped to speak to you but left a message on your answer machine. I didn’t call yesterday as I was still awaiting confirmation of funding. I have received this today and so can reply as follows:



I requested additional funding for the repair of this weir immediately after the Christmas holiday when it became apparent that the landowner was not going to fund these repairs and that the legal situation regarding maintenance obligations was far from clear – though on balance it looked like we were in the frame. Apparently the canal company sold the land in 1834 but for reasons unknown the maintenance obligation was retained by the canal company. I would sincerely hope that we wouldn’t do such a thing today! We will of course continue to address the legal position but I have no desire to do this and wait for the repairs to the detriment of canal users. We can fight any battle that is needed with an open waterway.



Anyway my request for funding has been recognised and £80K has been made available in the current financial year with the balance of the job being funded from next year’s contingency funds. The reality of the situation is that the omnibus contractors believe that £80K is the maximum that they could spend in the period once they arrive on site. Don’t have a firm date yet – we are having to balance the required timeliness of the works with the additional risk and costs associated with operating in such high water levels. John is looking at 3rd week in February though this has to be a best estimate at this stage. If we get in earlier then I have no doubt that if we can complete the job then we will do ahead of Easter and the funds will have to be found from somewhere.



I hope that this clarifies the position and that you no longer have to rely on rumour – always a dangerous thing and a source that you don’t need to rely on as I am always happy to provide you with an up to date and accurate position. I will include this information – updated as far as possible – in the article I will be writing for the next edition of The Butty. I understand that this is due with Di by the end of next week.

Many thanks indeed for that.. I wonder how many more of these we might find in the future.. Still, at least something is being done.. but pity BW are going to have to pay. You would think Kate Bush enjoyed her land enough with that beautiful water feature in her garden to put her hand into her multi-millions..
