Gravatar Don't worry, TF even without your admonishments I know where you stand on the First and the Second, and I am not going to talk about that nor am I taking up the "God-given rights" debate either.

In fact quite the opposite - the matter of child pornography.

I have made the comment several times now in my "The raruraru" series that the decision on "what is acceptable vs what is not", is in large part for the individual.

Child pornography, for reasons that I would have difficulty supporting beyond saying "There are limits on what is acceptable, even in my world", goes several steps beyond what can be justified by any means.

The same applies to the Danish cartoons of Mohammed, again with the same qualification.

The same applies to "humour" that is founded upon differences between "normal" and "not-normal" people.

So there you have it, TF. We agree. Perhaps for quite different reasons; we agree.

I can't imagine anyone being able to defend child pornography, at least not with a straight face.


Gravatar From the context of the Amendment and the Founders' own words in debate for/against adding it, "freedom of speech" was intended to address two fronts: religious speech and political speech. The Founders in no way saw "freedom of speech" in a way that could even concievably be extended to crucifixes in jars of urine, strip clubs, pornograhy, non-political, non-religious plays, books, etc., or even (especially--since it was brought up as a possible "political speech" issue in the Founders' own day) acts such as flag burning (indeed, the Founders specifically excluded such acts as not being speech, which, of course, they are not).

Most of what is defended today as free speech has nothing to do with the First Amendment as passed by the Founders, nothing at all. Indeed, most things defended as protected by "freedom of speech" today were widely regulated by the Founders' society in the form of State statutes.
