You can also see the article as it appears in the Daily Pennsylvanian. By being in plain view, wasn't the "information" that the couple was having sex already in the public domain and therefore not an invasion of the couple's privacy?
What do you legal-minded NDLS students think about the charge of sexual harassment?

I would personally like to thank the dude that took the pictures for doing a wonderful deed of public service.
Should he have to do community service as a result of this, he should take more pictures and post them on his website for the public to see!

The only charge that strikes me as having potential merit is the "acceptable uses of electronic resources" violation, which the student allegedly committed by "featuring the photo on his personal Penn Web site." But even that seems suspect, since Penn is a public school (right?). If I weren't so far behind in my First Amendment reading, I could comment more intelligently on this... as it is, perhaps Brian Foster or someone else from that class will chime in, and in the process give me exam tips, hehe j/k. :)

I remember learning in one of my photography classes in undergrad that if you are in public you can be photographed, whether you like it or not. If this picture was taken by someone who wasn't a student, there wouldn't be anything that could be done to them. If you're walking down the street naked, and someone takes a picture of you, that's not sexual harassment.
I agree with Brendan that all the student is really guilty of is violating the acceptable use policy, and maybe the school's code of student conduct.
What I find interesting is the fact that these two students who were having sex seem to show a worse reputation of Penn than the photographer. I'm sure that colleges want to promote their students having sex in front of windows for anyone to see. The article talks about how the picure caused the girl who lived in the room "'serious distress' and created 'an intimidating living environment for her.'" If you ask me, if you're going to do something so stupid, that's what you deserve. Then again, maybe I'm just brainwashed about sex at college from spending six years at ND.

Moral of the story, if you want to bang your brains out it might be a good idea to draw the shades, just a suggestion.

"University of Pennsylvania" sounds public... but that's why I wrote "right?"... I'm not certain. And I'm too lazy to look it up, even though a simple Google search would probably take less time than typing out this comment has. :) Anyone know?

Why would you think that the University of Pennsylvania sounds any more public than does the University of Southern California? It is, after all, an Ivy...

I don't recall seeing any acrobatic performances while at USC, though I definitely heard the results of one or two through open windows...
Mike, because Southern California is not a state, whereas Pennsylvania is. Are there any other private universities that have the name "University of [name of a state]?"

Undergraduate Student Government President Yaser Alamoodi is hoping to pass a rule that would prohibit males and females from posing in magazines he believes are damaging to ASU's reputation.
Is that even legal? As long as they are adults, can a public instution -- let alone a student government body -- bar anyone excercising her/his rights to pose nude?

There's only a slightly different structure to the name "New York University" than there is to "University of Pennsylvania", and NYU is private as well. In any event, I stand by the statement that the fact that they're part of the Ivy League makes it harder to envision them as a public school.

Kinda like how UCLA still loves to taunt USC as the "University of Spoiled Children" even though 'SC now gives out so much financial aid that UCLA students now actually have higher average family incomes than USC's...
Mike, I don't count NYU because in that case, I interpret "New York" as meaning New York City, and the "University of [a city]" usually is not public.

I've learned from my brother (an alumni of UPenn) that the university has dropped the charges, which was presumably the result of the heightened media attention.
Finally we are free to post photos of people doing things in public again!
