Can everyone see all the images? The first photograph is a picture of a trajectory dart in the side of the McKenzie barn. For some reason many of the images I've linked in the past day through image shack are not appearing. I can't see any of the images on here (stupid red X) but I can see them on your blog. I have to say, I initially watched the 2003 video, and feel that Liko was behaving poorly. At first, I thought it was the fatal confrontation, and couldn't understand why neither of them knew each other, if they had confrontations prior, but after my first cup of coffee, I realized that it wasn't the May 2007 video. I do agree with the neighbor, that it all probably could have been avoided, if either one of them, had gone out of their way to avoid the other. I'm still on the fence, as to "why" it had to happen, but I'm still reading about McKay, and his apparent power trip. And I watched the video the other day of Floyd, and his outburst in court.


Soobs, thanks for the info. and comment. Yes Liko was belligerent in 2003 but he was correct about his Civil Rights, specifically the Fourth Amendment. Judge Cyr ruled all of those arrests were without Just Cause because McKay and other officers seized the people without Probable Cause and I linked his rulings and the relevant memoranda online.

Plus you can tell McKay copped a 'tude when he saw it was a Kenney. On the photos I think I am going to go through today and get rid of imageshack and even worse I'm getting locked out from editing the post as soon as I get there it cuts me out. Strange.

I dunno Larkin, I think there's more than enough in here about the case, you know actual crime scene photos, motions, briefs, memoranda, etc. that no major media has done even though they pledged to do so and have more than enough money and resources to do so.

My blog is a diary so to that extent I detail what it's like to try a case like this.

Perhaps if you can cite to some passages or specific issues I can address your concerns.

I am retired journalist and editor and I understand you're a lawyer, and that you don't claim to be a journalist. However, had this story crossed my desk, I would have written "Too much of you" and sent it back to the reporter.

It isn't that journalists don't get involved in what they're reporting, they do. Sometimes they become part of the news themselves (as with the hallway attack and your lawsuit) but when you include it in the narrative, the reader's attention is drawn away from the real story at hand.

The real downside of your approach is that it runs roughshod over your own credibility. The reader inevitably queries the unspoken (and spoken) agendas of the writer and often doubts that they are getting anything like the unvarnished truth.

I left the business after something rather similar to this case. A Sheriff's deputy who ran amok in the rural county where we lived is most certainly guilty of several murders and of running a trucking company whose predominatn cargo was drugs. To make matters worse, the S.O. and the County Attorney were complicit. At least the Coroner and I were on the same side.

I can't tell you the hours I spent with DCI (the state investigators) and the FBI. I spent whole days testifying in related cases. I was sued by this deputy for libel, but prevailed out of court and won my legal fees. We were stalked. There were death threats. I used to sit with the parents of the victims (3 young women... now 4; and a teenage boy) and listen to them cry with rage and grief and frustration. Sometimes I cried myself.

I was going to buy a handgun for protection but was advised by someone in another branch of LE (where I had friends) not to, as the Concealed permit was handled through the S.O. and as Ed said, as soon as they knew I was armed, it gave them licesnse to kill me. I was advised by the FBI to pack it in or move or both. I wish I could say I stood my ground, but my son's life is worth more than that.

So it isn't that I don't understand what it's like to be up against an incredible miscarriage of justice. To see the guilty walk free and the complacent do nothing about it. But in the hundred thousand words (or more) I wrote about these incidents, the word "I" never once appeared. The story is not about me.

The blogs that have appeared here, mostly under Mr. Huff's pen, are not in diary form. (No judgment there, just statement.) They may be less formal than the standard, but they do appear objective in their presentation. I can see why you are so passionate about this case, but is your passion more important than the case itself?

Just some food for thought.


Will you be only blogging about cases you are involved in? Are there any other prosecutors you have any animus towards?

This is an interesting case you've posted about but unlike what Mr. Huff posts, which is very even handed and reasonable, in my humble opinion, these posts appear to be agenda driven or at the very least a bit self-aggrandizing.

Thank you for your comments. Larkin that sucks what happened to you. It's an insane World.

I hope you recognize that it takes a certain kind of character to do what I do, and some may find it aggrandizing where others find it conversational and real.

I know you covered stories and respect the fact that the word "I" never appeared and if that's what the people here want then that's what I'll give. At the same time remember that I'm the only one engaged in any litigation or Right-to-Know demands and there are a LOT of them circling around that can point to liability at any time. So it's different reporting on something and being the one doing most of what you're reporting on.

Hell, who else wrote letters to the Governor asking him to meet with the locals, then went to the Statehouse and made a movie about it?

Nobody.

As a former editor I take your comments to heart though and will endeavor to do whatever is necessary to bring you into this story.

I have mentioned other prosecutors I have animus toward but none of them tried to put me in prison for writing a Demand Letter when I was NAACP Legal Chair, a move that kept me from getting to Tamarack Tennis Camp in the first instance, which is why I never met Liko.

On my blawg I have addressed a ton of other issues involving corporate and municipal abuse but on this blog most of my writings will pertain to Franconia because it's a full time job, basically but I think I offered pretty intelligent commentary on the new post by Steve.

Lastly sometimes I qualify myself because I am so used to people saying "what do you know, and who respects you anyway?"

Which is PRECISELY why Mayor Streeter gave me that First Amendment/Right-to-Know Commendation, to help give me cred when I went to Court.

I want to see everyone on this board have one of those, not just me.

PS: I did go back and read carefully for the use of "I" and don't find it to be inappropriate. I said over the course of all three posts:

You've been fighting this battle for a long time. YOU. No one else is speaking for Liko. NO ONE.

I like your style and can understand why you're so invested in this story-- you're idealistic and honorable.

I am not concerned too much with how the story is presented, but if it helps new readers to have you pull back some of the "float like butterfly, sting like a bee" persona then set it aside and let your readers discover their passion for this fight.

It's a good fight.

Relative to Update #4:

If you read the Interrogatory and RFP's all I asked was for them to explain how Liko's gun went from being allegedly jammed to being locked and loaded as seen in the picture (not the one I used today but you know the one).

And no one can or will tell me that.

Great. At least we've got a good starting point for the family counsel and a nice chapter for Casey Sherman's forthcoming novel as soon as I close the loop by asking Troop F if they have anything.

So if they are going to stand by that statement it means that they just didn't give a damn about the whole issue, but that would again be a smack in the face to Trooper Cooper who specifically said as noted, that this was an important issue and that the lab was going to be studying the guns, etc. etc.

This ain't cool. This ain't any kind of cool.

Meanwhile, I am extremely concerned that I cannot locate any fingerprint evidence regarding Liko Kenney's gun because frankly, I don't think he was in any position to actually shoot Gregory W. Floyd on 5/11. Kelly said her office doesn't have anything but I find that hard to believe given what Trooper Cooper told Floyd:

Do you have any fingerprint analysis or ballistics analysis or any testing documents relating to either of the two firearms used on 5/11?

If so, please advise me of the cost of obtaining such materials pursuant to RSA-91-A and if they are available I would like to retrieve them on Monday as well.

Chris, I can see how others can see this as a one sided defence Of Liko's actions in his death and that you're on the attack. I also know why and how youve ended up being this way. If the powers that be had of accorded you a few shreds of honesty from the start, the wheels would have been put in motion to probably charge Floyd with murder and admit to McKays unethical history. Thats all youve ever asked for. Faced with the lies and the walls youve been handed you become angry. What they didnt realise is that unlike the poor people of Franconia you wouldnt just go away and put up with it. You went on the attack and you still are. When I first found this video on youtube I thought wow, thats pretty wild, I couldnt see why the cop would mace the kid or why the kid would shoot him for it so I looked a little deeper. The more I looked, the angrier I got about how much was covered up by firstly local authorities and then by the state Attorney General. It was obvious to a blind man that everyone was backpedalling to cover up not dealing with McKay in the past, even to the extent of allowing Likos crazed murderer to walk free as a hero... I never knew, Chris, Liko or McKay before seeing this event on youtube. I dont even live in the US but I could and can see that this is clearly a coverup by Governement Officials all protecting their backs for being at fault in allowing McKay to work as a Police officer. When even the local fire service fears a cop and the Firechief complains to to the Police cheif you knows theres a cop with problems. When nothing gets doen about it, you know the problem goes deeper. I really hope the people of Fraconia get behind Chris, morally and financially as he has 99% of the information needed to prove the corruption and put a killer behind bars.
