For another occsion - if something fails within a couple of weeks, you don't, legally, have to accept a repair. Insist on a replacement.

the repairs are actually done by a 3rd party not mitac. they are based in the same building as us, although moving to stafford park 15 on the weekend.

Try this (adding what you have just written in a separate letter)
Head the letter "LETTER BEFORE LEGAL ACTION" in big bold letters at the top.
Send a copy of it to your credit card company with a seperate letter telling them that you hold them jointly liable and quote Consumer Credit Act (see my previous post). Tell them you will "join them with Evesham" in any legal action you are forced to take.
Write to the company (recorded delivery) telling them that you are rejecting the goods because they are not of satisfactory quality and that you hold them jointly liable under Section 74 of the Consumer Credit Act 1973. Tell them you want an immediate refund.
SAMPLE LETTER
Dear Mr... (or Sir if you don't know his name).
Ref: Make and Model
On (date) I bought the above (item) from your company. It has developed serious defect(s). (Describe the faults).
The Sale of Goods Act 1979 requires you to supply goods which are of satisfactory quality. The law allows the buyer to have a reasonable opportunity to try things out. The fact that the (item) showed these defect(s) within (the time) of purchase shows that it was faulty when I bought it. You are therefore in breach of contract and having given you full opportunity to rectify the situation, I reject the (item) and claim a refund of the full purchase price of (£..........) from you.
I look forward to receiving this sum by (give a date). If you fail to reimburse me I shall have no alternative but to consider issuing a summons against you in the county court for the recovery of the money.

Evesham? We used to laugh at horror stories about them in the early 90s when they were "supplying" Amiga gear.

Are they still in business? God alone knows how they do it.
Demand a refund, they paid up quick enough when I asked for one on faulty goods on two orders made in the late 80's/early 90's. That's teh only good thing I can say about them. They didn't argue and they paid up quickly.

Check out all the reviews and good press on forums such as pcadviser, I've been an evesham buyer for years, and will continue to be due to their fantastic after sales service,
Every problem ive had, their engineers have help me solve over the phone.
While their quality of laptops appears to only be reasonable, their desktops can't be faulted.
It would be interesting to know if your company really has had "hundreds" of complaints about evesham, or if thats just your way of trying to get back at them for your poor experience.

I also have an Eveshambles Laptop and an almost identical story! It has been sent back to repair the case twice. It seems opening and closing it causes it to break apart!?
It has been away for 8 weeks now so they 'built' and sent me a 'new' laptop. Although when it arrived it was the same model (almost 2yr old) and covered in dust!
Laughable? yes. Lies? Yes. Happy? No.

i know this is a strange request due to the topic but i actually like my evesham 8317 lol i do agree with you on the company in general they have been beyond Shit. i broke my screen and they refused to fix it even though i had free repairs to a certain point so im a little annoyed, anyway do you still have the laptop any chance i can get the screen lol i feel your pain with evesham friend
